In Arushi Talwar Case, both the accused Rajesh Tawlar and Nupur Talwar were convicted because they could not explain the murder of Arushi and Hemraj in their house, hence it was presumed that they killed them. So extending the same analogy it was up to Salman Khan to explain who was driving his vehicle, it is not in doubt that he was not in the fateful vehicle, he was. Since he failed to explain the same he should have been convicted.
I am not saying that this is the right legal approach, but the application of the criminal law in our country does not appear to be deterministic.
